Brazilian Supreme Court Issues Arrest Warrant for Eduardo Bolsonaro Weeks Before High-Stakes Presidential Runoff

BRASILIA — In a dramatic escalation of Brazil’s high-stakes political conflict, a Supreme Court justice has issued an arrest warrant for Eduardo Bolsonaro, the brother of right-wing presidential candidate Flavio Bolsonaro. The decision, delivered just weeks before a bitterly contested presidential runoff election, is expected to further polarize an electorate already deeply divided between incumbent President Luiz Inacio Lula da Silva and the Bolsonaro family camp, where Flavio currently stands as the favorite to win the presidency.

The arrest warrant, handed down on Thursday by Supreme Court Justice Alexandre de Moraes, marks the latest chapter in a multi-year judicial and political saga involving the influential Bolsonaro family. The ruling arrives at a critical juncture in Brazilian politics, heightening tensions as the nation prepares for the October 25 runoff election between the left-leaning incumbent Lula and the conservative challenger Flavio Bolsonaro. Both sides of the deeply entrenched partisan divide have long accused one another of corruption, institutional overreach, and politically motivated lawfare, creating an atmosphere of intense friction as the campaign reaches its final stretch.

Lobbying the US and Foreign Interference Conviction

The legal jeopardy facing Eduardo Bolsonaro stems from actions he took following the legal troubles of his father, former right-wing President Jair Bolsonaro. In June, the Brazilian Supreme Court formally convicted Eduardo Bolsonaro on charges of lobbying United States officials to interfere in the judicial proceedings and trial of his father.

According to court findings, Eduardo Bolsonaro acted as a crucial liaison between his political allies in Brazil and the administration of United States President Donald Trump. His diplomatic outreach included accompanying his brother to a high-profile meeting with President Trump at the White House in May, a visit that underscored the family’s efforts to rally international support against the Brazilian judiciary.

The fallout from these international maneuvers was swift and severe. In March 2025, Eduardo Bolsonaro announced a dramatic pivot in his personal and professional life, pledging to relocate to the United States on a full-time basis to dedicate “100 percent” of his energy to securing the freedom of his father. This voluntary exile cost the 42-year-old politician dearly on the home front, forcing him to forfeit his seat in the Brazilian National Congress as well as his official position as a federal police investigator.

Presently residing in Texas as a green card holder, the former lawmaker was tried and convicted in absentia for orchestrating a campaign aimed at pressuring foreign powers. Prosecutors established that his lobbying efforts specifically targeted the implementation of economic sanctions against members of the Brazilian government, alongside advocacy for higher tariffs on key Brazilian exports, all designed to exert leverage during his father’s landmark trial.

Supreme Court Justice Alexandre de Moraes at the Center of the Storm

At the heart of the legal battle is Justice Alexandre de Moraes, a polarizing figure who is viewed by the Bolsonaro family and their supporters as a partisan political enemy. De Moraes previously chaired the exhaustive judicial investigation that resulted in the historic conviction of former President Jair Bolsonaro. In September 2025, that investigation culminated in a 27-year prison sentence for the elder Bolsonaro, who was found guilty of orchestrating a conspiracy to stage a coup against the Brazilian government.

In his latest ruling regarding the former president’s son, Justice de Moraes ordered that Eduardo Bolsonaro must begin serving his four-year prison sentence immediately upon capture. The justice emphasized that the defendant could not be allowed to evade justice by exploiting his absence from the country.

“The defendant cannot benefit from his own wrongdoing by fleeing the national territory to an unknown location for the purpose of thwarting the application of criminal law,” Justice de Moraes wrote in his ruling.

To enforce the judgment, de Moraes officially canceled Eduardo Bolsonaro’s Brazilian passport and issued a direct directive to the country’s federal police forces, instructing them to execute the arrest immediately should the former congressman attempt to re-enter Brazilian territory.

As the October 25 runoff election approaches, the intersection of these ongoing legal battles and the presidential campaign continues to dominate the national conversation. With Flavio Bolsonaro leading the charge for the right wing against President Lula, the Supreme Court’s latest action against his brother ensures that the judiciary, foreign relations, and the legacy of the Bolsonaro administration will remain central themes in the closing weeks of Brazil’s most consequential political contest in recent history.
