The UK’s data protection regulator has issued a formal legal order against the prominent Muslim charity Penny Appeal, commanding the Wakefield-based organization to immediately cease bombarding members of the public with unsolicited promotional text messages during the holy month of Ramadan.
The Information Commissioner’s Office (ICO)—the independent public body in the United Kingdom tasked with upholding information rights, data privacy, and data protection laws—stepped in following a sustained campaign of illegal marketing. Between April and May 2022, as Muslims worldwide observed the fasting month of Ramadan, Penny Appeal deployed a wave of promotional text messages urging recipients to donate to its various charitable appeals.
According to findings by the regulatory authority, the charity transmitted more than 460,000 unsolicited marketing texts over a concentrated ten-day period. These messages reached approximately 52,000 individual mobile phone users who had either never granted explicit consent to receive such communications or had previously and clearly opted out of marketing campaigns. A significant portion of these texts specifically targeted potential donors with appeals to channel their Zakat—a mandatory form of Islamic almsgiving and one of the fundamental pillars of Islam—directly to Penny Appeal.

The aggressive messaging strategy triggered a wave of public frustration, culminating in 354 formal complaints lodged with both the ICO and Mobile UK’s dedicated Spam Reporting Service. Numerous individuals who received the texts reported that their explicit requests to opt out of future communications were routinely ignored by the charity. Complainants frequently characterized the influx of messages as intrusive, unwanted, and disruptive during a period meant for spiritual reflection and devotion.
The ICO serves as the UK’s frontline defense for information rights, wielding statutory powers to take robust action against organizations and individuals that flout regulations regarding the collection, handling, and retention of personal data. The regulator’s toolkit ranges from non-criminal enforcement notices and formal audits to full criminal prosecution for severe breaches of data privacy legislation.
The regulatory clash with Penny Appeal is not a recent development. The watchdog has maintained an ongoing dialogue with the Wakefield-based charity since 2020, following a prior round of public complaints concerning a separate direct marketing campaign. In the wake of those initial interventions, Penny Appeal formally committed to overhauling its internal operations to align fully with UK direct marketing laws and ensure strict compliance moving forward.
Despite those prior assurances and the technical guidance provided by the regulator, subsequent investigations and fresh public complaints revealed that the charity was continuing to dispatch unauthorized promotional texts. The ICO noted that even while the charity was actively under active regulatory investigation for previous infractions, it pressed forward with another wave of spam text messages during the Ramadan season, compounding the grievances of consumers and prompting further public complaints.

Consequently, the ICO escalated its response by issuing a formal Enforcement Notice. The legal order compels Penny Appeal to completely halt the transmission of direct marketing communications without prior explicit consent within a strict 30-day window.
Andy Curry, the Head of Investigations at the ICO, elaborated on the severity of the charity’s compliance failures and the rationale behind the enforcement action. He emphasized that Penny Appeal had inundated citizens with text messages while showing a blatant disregard for individual consent and the legal right to opt out of promotional material.
Curry described the charity’s conduct as completely unacceptable, affirming that the regulatory body will act decisively to safeguard the public from unsolicited marketing spam. He explained that despite substantial efforts to provide guidance, advice, and a clear path toward regulatory compliance, the repeated violations left the watchdog with no alternative but to deploy statutory enforcement measures.
At the same time, the ICO acknowledged the vital role that charitable organizations play within society, noting the importance of enabling charities to responsibly raise funds for honorable causes and assist vulnerable populations, particularly when public generosity peaks during religious seasons. The regulator also recognized that smaller or mid-sized charities might occasionally require additional support to navigate complex data protection legislation, offering ongoing assistance to organizations striving to get their compliance frameworks right.

Nevertheless, the regulator drew a firm line regarding accountability, stressing that any organization engaging in direct marketing bears the absolute legal responsibility to secure proper, verifiable consent from recipients. The ICO encouraged members of the public experiencing similar issues with unwanted spam messages or automated calls to come forward, reiterating its commitment to supporting consumers against intrusive marketing practices.
In response to the regulatory action and the public outcry, a spokesperson for Penny Appeal issued an official statement addressing the charity’s position and outlining its plans for institutional reform. The spokesperson maintained that the organization remains deeply committed to continuous operational improvement and to fostering the highest possible standards of corporate governance.
As part of this ongoing transition, Penny Appeal confirmed that it has initiated a comprehensive, internal review covering all aspects of its data utilization and compliance frameworks. This review encompasses rigorous procedures for data hygiene, including the ongoing cleansing and verification of contact lists held within the charity’s databases. The organization concluded by reaffirming its dedication to maintaining a cooperative working relationship with the ICO and other relevant statutory agencies, emphasizing its primary mission to support and strengthen charitable aid for the vulnerable communities it was established to serve.
